Terms of Service

1. Introduction

By accessing or using CalcEmbed (“the Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Service Description

CalcEmbed is a software-as-a-service (SaaS) platform for creating and embedding interactive calculators on websites. We provide a visual builder, hosting, embed delivery, lead capture, analytics, and webhook integrations.

3. Accounts

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• Each account is for a single individual. Sharing login credentials is not permitted.
• You must be at least 18 years old to create an account.

4. Free and Paid Plans

CalcEmbed offers a free plan with usage limits and paid plans with additional features and higher limits. Paid plans are billed monthly or annually via Stripe.

• You may cancel your subscription at any time. Access to paid features continues until the end of the current billing period.
• We do not offer refunds for partial billing periods.
• We reserve the right to change pricing with 30 days' notice. Existing subscriptions will be honored at their current rate until renewal.

5. Acceptable Use

You may not use CalcEmbed to:

• Collect personal data illegally or without appropriate consent.
• Distribute malware, phishing content, or spam.
• Create calculators that violate applicable laws or regulations.
• Attempt to access, tamper with, or disrupt the Service or other users' accounts.
• Resell or redistribute the Service without our written consent.

We reserve the right to suspend or terminate accounts that violate these terms, with or without notice depending on the severity of the violation.

6. Customer Responsibilities for Lead Data

If you collect personal information through your embedded calculators (such as names, email addresses, or phone numbers), you are responsible for:

• Complying with all applicable privacy laws, including GDPR, CCPA, and any other relevant regulations.
• Informing your website visitors about what data is being collected and how it will be used.
• Providing a privacy policy on your website that covers data collected through embedded calculators.
• Handling opt-out and deletion requests from individuals whose data you have collected.

CalcEmbed acts as a data processor for lead data collected through your calculators. You are the data controller and bear primary responsibility for lawful data collection.

7. Intellectual Property

• Your content: you retain ownership of your calculator configurations, branding assets, and collected lead data.
• Our platform: CalcEmbed, including its code, design, branding, and documentation, is owned by us and protected by intellectual property laws.
• You grant us a limited license to host and display your calculator configurations as part of providing the Service.

8. Limitation of Liability

CalcEmbed is provided “as is” and “as available” without warranties of any kind, either express or implied. To the fullest extent permitted by law:

• We are not liable for any indirect, incidental, special, or consequential damages, including lost data, lost revenue, or business interruption.
• Our total liability for any claims arising from your use of the Service is limited to the amount you paid us in the 12 months preceding the claim.
• We do not guarantee uninterrupted or error-free service, though we make reasonable efforts to maintain uptime.

9. Termination

Either party may terminate this agreement at any time.

• You may delete your account from the Settings page in your dashboard, or by emailing us.
• We may terminate or suspend your account if you violate these terms.
• Upon termination, we will make your data (calculator configurations and lead data) available for export for 30 days. After that period, your data will be permanently deleted.

10. Changes to These Terms

We may update these terms from time to time. We will notify you of material changes via email or a notice in the dashboard. Continued use of the Service after changes take effect constitutes acceptance of the updated terms.
